Veretelnyk, Iegor ; Uhl, Pavel (advisor) ; Hřebejk, Jiří (referee)
1 Comparison of the legal regulation of citizenship of the Czech Republic and Ukraine during the period of independent states Abstract The aim of this thesis is to take a closer look at the phenomenon of state citizenship through the prism of the state-citizenship regulation of two young states with different legal continuity and history. Namely, the Czech Republic and Ukraine. State citizenship is a dynamic concept undergoing transformation simultaneously within human society and its values in general and legal culture in particular. The transformation of this phenomenon can be generalized on the dichotomous scale of "state power - individual", when in the context of, among other things, international law and specifically human rights doctrine, the concept of citizenship in most states is increasingly approaching the pole of individual; when it ceases to be the sovereign domain of state discretion and unlimited state power but begins to be seen as a human right or even a free choice of the individual. The main objective of this thesis was to determine whether the two countries of study have also approached this concept with their state-citizenship arrangements, and to determine to what extent the current Czech and Ukrainian citizenship legislation is shaped, or influenced, by previous legal arrangements in...

State citizenship in adjudication
Vasilieva, Yanina ; Hřebejk, Jiří (advisor) ; Jirásková, Věra (referee)
75 Abstract The aim of this work is to describe and analyze the concept of the state citizenship in general and in the Czech Republic from a theoretical and practical point of view. At the theoretical level, this work explores the concept of state citizenship and the related terms such as nationality analyzed in the first chapter that has a broader conceptual content. Nationality is used as a benchmark concept to distinguish vertical and horizontal levels of state citizenship. At the vertical level, often referred to as functional citizenship, the focus is on the relationship between the state and its citizens. By contrast, the horizontal level concentrates on ties between citizens within a state that are based on solidarity and collective sense of belonging. This leads to the particular role of state citizenship that provides an individual with a set of privileges such as legally enshrined special treatment by the state. The second chapter of this work studies the historical development of the state citizenship on the Czech territory since 1918. This chapter clearly demonstrates important institutional legacies from the first Czechoslovak Republic that were overtaken by the new regime after 1989. Related legal resources of state citizenship are examined in the next chapter that scrutinizes them as part of...

Hlubučková, Kristýna ; Hřebejk, Jiří (advisor) ; Uhl, Pavel (referee)
Rejection of an application for citizenship of the Czech Republic due to a security threat Abstract This diploma thesis focuses on the analysis of a minority opinion, based on the thesis that a restriction of procedural rights of applicants for citizenship whose application was rejected due to a security threat is not fully in line with the principle of poportionality and the fair trial right. The assessment of whether the principle of proportionality has been mainteined is based on comparison of the value of state security and the potential interference with the (fundamental) rights and freedoms of the applicants. Furthermore, the thesis deals with the procedure of the Ministry of the Interior in assessing the positions of the intelligence services of the Czech Republic and the Police of the Czech Republice and the role of the Constitutional Court and the Ombudsman in the proces of reviewing potential interference with (fundamental) rights and freedoms of citizenship applicants. For the purpose of the analysis of the statements outlined above is used: case law of the Constitutional Court of the Czech Republic on the provisons of Article 22 Paragraph 3 and Article 26 of Act No. 186/2013 Coll., On Citizenship of the Czech Republic, and the Explanatory Memorandum to this Act. The studies of academics had been...

1 Abstract Nationality in sport environment The main task of this thesis is to consider the current state of nationality in sport environment with the respect to increasing numbers of international transfers of athletes and the following possible connections of nationality and sport eligibility. At the same time, I am trying to find the answer to question whether it is possible to create complex regulations within international sport law on this issue. The main sources for my research were international treaties, different national laws and also European Union Law. Since much of this work is influenced by lex sportiva it became an integral part of this work as well. Within the first and second chapter I am dealing with the concepts of nationality and naturalization in general, which are analyzed mainly in the light of international treaties, international customs and available case law. I am complementing this data with the findings of national regulations which have had great influence for the field of nationality. In the following text I am analyzing the concept of sport eligibility, mainly its content and significance in general and within this work. I am doing this with the help of the judgments of the Court of Arbitration for Sport and the doctrinal articles. In Chapter Five I am referring to possible...

This diploma thesis is focused on demographic issues of this minority. The thesis also deals with demographic differences between the Czech and Vietnamese population living in the Czech Republic. In addition, the thesis offers selected demographic features through which demographic disparities between the two parts of the population are analysed. The theoretical part of the thesis is focused on the legislative issues of terms such as: citizenship, nationality and mother tongue, as it is very important to understand and distinguish these terms, especially for the analytical part of the thesis. Each term is defined and described in the introduction, so the differences between terms are explained. However, more attention is paid to the term citizenship, as the analytical part of the thesis is based primarily on this term. In the theoretical...
